CANCELLATION AND REFUND POLICY
1. Within three days from the date of sale, customer ("you") may cancel the order and receive a full refund of any payments made for merchandise and delivery fees, except that payments made by check will only be refunded after 14 days and the check has cleared our bank.
2. After 3 days from the date of sale, you may cancel the order and receive a refund of any payments made for merchandise and delivery fees, except that the following fees shall be deducted from such refund:
a. For non-special orders or non-customized merchandise, 25% of the total purchase price of the merchandise cancelled, and
b. On special orders or customized merchandise, 50% of the total purchase price of the merchandise cancelled.
3. Should you pick up the merchandise or if delivery of the merchandise is made, then notwithstanding the time periods set forth above for refunds, you will no longer be entitled to any refund or credit.
4. You are solely responsible for all dimensions and measurements. In the event merchandise does not fit through doors, up stairs, down stairs, or in the room you will be solely responsible. No-fit merchandise may be returned for only store credit, only if the merchandise is delivered to you, the merchandise is returned at the time of delivery to the persons delivering the merchandise and the persons delivering the merchandise are able to confirm that the merchandise does not fit. In such event, the following fees shall be deducted from the store credit:
a. For non-special orders or non-customized merchandise, 25% of the total purchase price on the merchandise returned, plus the delivery charge, and
b. On special orders or customized merchandise, 50% of the total purchase price on the merchandise returned, plus the delivery charge.
Only the pieces of merchandise that do not fit may be returned for store credit. If you pick up the merchandise or accept delivery of the merchandise, the merchandise may not be returned for a refund or store credit. In the event a store credit is issued to you, any merchandise purchased using the store credit which is delivered will be subject to a delivery charge at the then current delivery rate.
5. Unless otherwise agreed in writing, you must accept delivery of the merchandise within 14 days from the time we notify you by telephone, mail or other means that your merchandise is ready for delivery. If you are unable or otherwise do not wish to accept delivery within the 14 day period, you must immediately notify The Bedroom Source ("us" or "we") and we will attempt to assist you. If you do not accept delivery of the merchandise within the 14 day period, you will nevertheless be required to pay us in full for the merchandise within the 14 day period. If full payment is not received within the 14 day period or if we are unable to contact you by telephone, mail or other means after making at least three attempts, we shall have the right to resell the merchandise in which case your deposit will be forfeited. If you cannot accept a scheduled delivery, you must notify us at (516) 248-0600 at least 24 hours prior to the scheduled delivery to avoid a redelivery charge.
6. If merchandise is picked up at our premises, you are responsible prior to loading the merchandise to inspect the merchandise and notify us in writing of any damages or other claims. We will not be responsible for any damages or other claims filed after the merchandise has begun to be loaded or after you have agreed in writing that the merchandise is in good condition, whichever occurs first.
7. If the merchandise is delivered by us, you are responsible prior to the delivery being completed to inspect the merchandise and notify us in writing of any damages or other claims. We will not be responsible for any damages or other claims filed after the delivery of the merchandise has been completed or after you have agreed in writing that the merchandise is in good condition, whichever occurs first.
8. Lead times for deliveries are approximate, and are subject to change based on availability by the manufacturer. In no event may an order be cancelled due to lateness, unless lead time exceeds 10 weeks. If lead time exceeds 10 weeks, you have the right to cancel the order for a full refund, or accept a later delivery date.
